Hi there,

I wonder if anyone can offer me some advice.

I am being offered a cottage in upstate NY but it is listed as seasonal residence. Will it be a problem if stay in it round the year? Will there be any legal hassles?

Its in Monroe on a private road and there are no lakes nearby.

many private roads are seasonal use only...where is Monroe? North of Oneida lake? There are a few Monroe's in NY. There's a Monroe County too.

I have been told that the road is accessible during winters. This Monroe is in Orange county close to Harriman state park.

It is probably an association. They would make their own rules to be voted on yearly etc.

Orange county is not upstate ny. You should ask the town or the association this question.

Seasonal could be also no different, except the taxing feature. A part time use, usually 60 or 90 days max allows for a lower taxed rate, ie recreational/vacation cabin, while a year round living residence is taxed at a higher rate. Usually goes by square footage of living space.

The idea behind it was to make a vacation spot more affordable for us working class stiffs.

But it can also means no snow plowing in winter, so not accessible as others mentions.

If they call it seasonal because theres no snow plowing that dosnt mean theres no acess. That means you just have to find other means to get there.

Our property is on a non plowed road. We walked in. If you plan properly in fall you can live very nicely in winter.
