Look like a dwelling setting empty (like a cabin does) can be confiscated by anyone for just $16 and its legal!

It would seem a major difference between that case and the case of a typical cabin is that the "owner" of that property quit paying the mortgage and taxes. It was abandoned. A typical cabin is either paid off or the owner is making regular payments and is sure to pay the annual property taxes.

On a similar nore; there are laws that someone could take advantage of that would permit someone to claim a piece of your land. If someone decides to use a piece of your land and they do it long enough, even without your knowledge, they may after a certain time have a legal claim on that piece of land. The "law of Adverse Possession" can differ greatly from state to state, but all states have such laws in one form or another. It only applies to privately held land; you can't claim a piece of national forest for example. Also if you give permission to the other party to use a piece of land then the law does not apply; they can not make legal claim in that case. It can get complicated.

he better have more than $16 if he tries to get my cabin...... :-)
cabin and property paid for---property taxes were paid 3 months early......
and elect bill...... has a least a $250 dollar OVERpayment......so i don't have to pay a $18 bill every month.....
cabin insurance paid till 6 /2012.........
on a well so no water payment or nothing.....
and i have a gun or 20 ;-).........

Every U.S. landowner should be aware of the laws regarding Prescriptive Easement and Adverse Possession. And not just those who own land in the country, but maybe more importantly those who live in the city where lots are much smaller and neighbors encroach on each other regularly- by intent or accident.

Here in D-FW, TX, those squatting and filing for adverse possession are being arrested and prosecuted. So, with those cases active and underway, AP will not hold up here. Saw a "family" on the news just last nite that were arrested for squatting and AP. Don't think its gonna work out for the occupiers!

I think this case is very uncommon as the mortgage company also went under, that leaves nobody to claim the house that previously owned it , right ?

Exactly right. That set of circumstances is not too likely to repeat.

Very unlikely that any of us will ever find ourselves on either side of that fence.
